Compensation Defined
DEFINITION OF COMPENSATION
The Delaware Constitution provides that no property may be taken or applied
to public use without just compensation. You must determine the amount of
compensation that is just and fair both to the owner of the property and to the public
represented by the condemning authority. Your decision must be based wholly on
the evidence presented before you in these proceedings, considered in light of your
view of the property and in light of the legal principles stated in these instructions.
