Procuring Cause
PROCURING CAUSE
Procuring cause refers to the efforts of an agent or broker who brings about the
sale of real estate and is therefore entitled to a commission. If there are two or more
brokers who have non-exclusive listings for a particular property, the broker whose
efforts predominate in bringing about the sale is entitled to the commission.
You must determine by a preponderance of the evidence whether [broker A’s
name] or [broker B’s name] [and any other brokers] made the predominant effort
that brought about the sale of [describe real estate] to [purchaser’s name].
