Duty of Party in Control of Premises to Workers on the Site
EMPLOYEES ON PREMISES – CONTRACTOR’S DUTY TO
EMPLOYEES OF ANOTHER CONTRACTOR OR SUBCONTRACTOR
[Plaintiff’s name] was an employee of [__________] on the premises under a
contract with [owner, contractor, or subcontractor’s name].
A contractor who is in control of the workplace must provide a safe
environment to work. This does not mean that the contractor guarantees or insures
the safety of the workplace. The extent of the contractor’s duty is to exercise
ordinary care, under the circumstances, to see that the workplace is reasonably safe.
If you find that [defendant’s name] failed to perform this duty, then [he/she/it]
was negligent.
