Liability to Rescuers
LIABILITY TO RESCUERS
When a person negligently creates a situation in which it is reasonably
foreseeable that rescuers will attempt to save a victim in peril, that person is liable
for any injuries caused to the rescuers.
In this case, it is alleged that [person A] was injured while trying to save [person
B]. If you find that [defendant’s name]’s negligence caused the situation that led to
this rescue attempt, and that this rescue attempt was a reasonably foreseeable
consequence of [defendant’s name]’s negligence, you must find for [person A].
