Applicability of Superior Court Rules of Civil Procedure
(a) CIVIL RULES INCORPORATED BY REFERENCE. The following Superior Court
Rules of Civil Procedure are incorporated by reference:
(1) Rule 6, except where inconsistent with these rules or D.C. Code § 7-1301.02 et
seq.;
(2) Rule 59(e); and
(3) Rule 60.
(b) Otherwise, the Superior Court Rules of Civil Procedure apply to habilitation
proceedings, except where inconsistent with these rules or the nature of the
proceedings.
History
COMMENT TO 2026 AMENDMENTS The prior version of Rule 3 addressed admission to a habilitation facility but has been deleted and replaced in light of the enactment of the Disability Services Reform Amendment Act of 2018, D.C. Law 22-93, 65 D.C. Reg. 2823 (2018), which ended new commitments other than commitments of persons found incompetent in criminal cases. New sections (a) and (b) modify the provisions previously included in former (and now deleted) Rules 8A and 8B and specify the circumstances in which the Civil Rules apply in habilitation proceedings.
