Findings of Fact and Conclusions of Law
(a) IN GENERAL. Within 10 days after the review hearing, the respondent’s attorney
must serve on the Assistant General Counsel for the District of Columbia Department
on Disability Services proposed written findings of fact, conclusions of law, and orders
as the court may direct. The Department must respond within 10 days with any
objections or corrections, along with any proposed alternative language. The
Department’s failure to respond within 10 days is considered consent to the proposed
order.
(b) ANNUAL REVIEW HEARING. Within 5 days after receiving the Department’s
objections or corrections or failure to respond, the respondent’s attorney must send joint
proposed written findings of fact, conclusions of law, and orders to the court, and where
there is any disagreement, the joint proposed written findings must include both
versions of the opposing language as alternatives.
History
COMMENT TO 2026 AMENDMENTS This rule was formerly designated as Rule 15. The rule also has been amended to conform with the general restyling of the Superior Court rules.
