Failure to Appear for Trial as Consent to Trial Without Jury

Failure of a party to appear for trial, in person or through counsel, will be deemed by

the court to constitute consent by that party to a trial without a jury.

History

COMMENT TO 2017 AMENDMENTS Stylistic changes were made to this rule to conform with the 2007 amendments to the Federal Rules of Civil Procedure.
