Partners - Defined
One of the issues in this case is whether <insert names of partners> were partners. Persons who
associate for the purpose of carrying on as co-owners of a business for profit are partners. A
partnership exists as a result of an agreement of the parties. That agreement may be written,
verbal or implied. A person who receives a share of the profits of the business is presumed to be
a partner in the business. The existence of a partnership is a question of the intention of the
parties to be determined by you from all the facts and circumstances.
