SECOND DEGREE CONTRIBUTING TO THE DELINQUENCY OF A MINOR
The elements of the crime of second degree contributing to the
delinquency of a minor are:
1. That the defendant,
2. in the State of Colorado, at or about the date and place charged,
3. knowingly induced, aided, or encouraged another to violate
[insert a reference to the municipal or county ordinance, court
order, or state or federal law that is not a felony victims rights
act crime under section 24-4.1-302(1)], and
4. the person who was induced, aided, or encouraged by the
defendant was under the age of eighteen years.
[5. and that the defendant’s conduct was not legally authorized by
the affirmative defense[s] in Instruction[s] ___.]
After considering all the evidence, if you decide the prosecution has
proven each of the elements beyond a reasonable doubt, you should find
the defendant guilty of second degree contributing to the delinquency of a
minor.
After considering all the evidence, if you decide the prosecution has
failed to prove any one or more of the elements beyond a reasonable doubt,
you should find the defendant not guilty of second degree contributing to
the delinquency of a minor.
