The elements of the crime of unlawful sale of ammunition (underage)

are:

1. That the defendant,

2. in the State of Colorado, at or about the date and place charged,

3. was a retail ammunition vendor, and

[4. sold ammunition to a person who was under twenty-one years

of age.]

[4. prior to completing a sale of ammunition at an in-person

transaction, the defendant or [his] [her] employee did not verify

that the purchaser was at least twenty-one years of age by

requiring the purchaser to produce a valid government-issued

photo identification.]

[5. and that the defendant’s conduct was not legally authorized by

the affirmative defense[s] in Instruction[s] ___.]

After considering all the evidence, if you decide the prosecution has

proven each of the elements beyond a reasonable doubt, you should find

the defendant guilty of unlawful sale of ammunition (underage).

After considering all the evidence, if you decide the prosecution has

failed to prove any one or more of the elements beyond a reasonable doubt,

you should find the defendant not guilty of unlawful sale of ammunition

(underage).
