COLJI-Crim. 12-1:48
UNLAWFUL MANUFACTURE, DISTRIBUTION, TRANSFER, SALE, OR PURCHASE OF A SPECIFIED SEMIAUTOMATIC FIREARM (APPLIES TO CONDUCT COMMITTED ON OR AFTER AUGUST 1, 2026)
The elements of the crime of unlawful manufacture, distribution,
transfer, sale, or purchase of a specified semiautomatic firearm are:
1. That the defendant,
2. in the State of Colorado, at or about the date and place charged,
3. knowingly,
4. manufactured, distributed, transferred, sold, or purchased, a
specified semiautomatic firearm, and
5. [he] [she] did not sell or transfer the specified semiautomatic
firearm to an individual residing in another state or a federally
licensed firearm dealer.
[6. and that the defendant’s conduct was not legally authorized by
the affirmative defense[s] in Instruction[s] ___.]
After considering all the evidence, if you decide the prosecution has
proven each of the elements beyond a reasonable doubt, you should find
the defendant guilty of unlawful manufacture, distribution, transfer, sale,
or purchase of a specified semiautomatic firearm.
After considering all the evidence, if you decide the prosecution has
failed to prove any one or more of the elements beyond a reasonable doubt,
you should find the defendant not guilty of unlawful manufacture,
distribution, transfer, sale, or purchase of a specified semiautomatic
firearm.
