Affirmative Defense — Negligence or Fault of Designated Nonparty
The affirmative defense of the (negligence) (or) (fault) of the nonparty, (insert name
or other appropriate description), is proved if you find all of the following:
1. (insert name or other appropriate description of the nonparty) was (negligent) (or) (at
fault); and
2. The (negligence) (or) (fault) of (insert name or other appropriate description of the
nonparty) was a cause of the plaintiff’s claimed (injuries) (damages) (losses).
