Actual Authority — Defined
An agent acts with actual authority when, at the time of taking action that affects
the principal:
1. The agent believes (insert applicable pronoun) actions are consistent with the way
the principal wishes the agent to act; and
2. The agent’s belief is reasonable.
In determining whether the agent’s belief is reasonable, you should consider the
principal’s words (and) (or) conduct directed to the agent and the agent’s understanding of
the principal’s wishes.
