Use of Present Tense — Dependency and Neglect
A finding of dependency and neglect may be based on evidence that the child was
subjected to neglect or abuse in the past (and will likely be neglected or abused in the
future, if returned to the parent’s care). The present tense as used in these instructions and
verdict forms includes the future tense.
