Constructive (Implied) Discharge
Even if the plaintiff resigned from (insert applicable pronoun) employment, if you
find that the words spoken or actions taken by the defendant would have led a reasonable
person in the plaintiff’s position to believe, and did lead the plaintiff to believe, that (insert
applicable pronoun) had been or was going to be discharged by the defendant, then the
plaintiff was, in fact, discharged by the defendant.
