Manufacturer — Defined
“Manufacturer” means:
(1. A person or entity who designs, assembles, makes, produces, constructs or
otherwise prepares [a product] [or] [a component part of a product] prior to the sale of the
product to a user or consumer;)
(2. A seller who has knowledge of a defect in a product;)
(3. A seller who creates and furnishes a manufacturer with specifications for a
product that are related to the alleged defect [whether or not the seller placed a private
label on the product];)
(4. A seller who exercises some significant control over all or a portion of the
manufacturing process or who alters or modifies a product in any significant manner after
the product comes into [his] [her] [its] possession and before it is sold to the ultimate user
or consumer [whether or not the seller placed a private label on the product];)
(5. A seller who placed a private label on the product and did not disclose who the
actual manufacturer is).
