Manufacturer’s Duty as to Parts Obtained from Other Sources

When the manufacturer of (an article) (a product) uses any material or part

obtained from another source, the manufacturer has a duty to inspect (and) (or) test that

material or part to the extent a reasonably careful person would under the same or similar

circumstances, to make the finished (article) (product) reasonably safe for the uses to which

it might reasonably be expected to be put. Failure to fulfill that duty is negligence.

However, if the manufacturer performs that duty, the manufacturer is not

responsible for (injuries) (damages) (losses) resulting from the use of that material or part,

even though it may be defective.

On the other hand, if the manufacturer performed that duty, but later becomes

aware of a defective or dangerous condition resulting from the use of the material or part,

then the manufacturer has the duty to give notice of the defect or danger to such persons

and in such manner as a reasonably careful person would give under the same or similar

circumstances to avoid (injuries) (damages) (losses) to others.
