Notice of Breach of Warranty — What Constitutes
Plaintiff, (name), cannot recover for breach of warranty unless (insert applicable
pronoun) notified the defendant, (name), of the breach within a reasonable time after the
plaintiff discovered or should have discovered the breach. You must decide what is a
reasonable time based upon the facts and circumstances.
Notice may be oral or written. No particular form of notice is required as long as it
informs the defendant of the breach.
