TheColoradoDepartmentofHealthCarePolicy&Financing(theDepartment)iscommittedtoensuringtheprivacyandsecurityofHealthFirstColorado(Colorado'sMedicaidProgram)members'protectedhealthinformation.Tosupportthiscommitment,theDepartmenthasimplementedandwillcontinuetomaintainappropriatepolicies,proceduresandmechanismstoprotecttheprivacyandsecurityofProtectedHealthInformationthatisusedordisclosedbytheDepartment.

AsthesinglestateagencyresponsiblefortheadministrationofHealthFirstColoradopursuanttoTitleXIXoftheSocialSecurityAct,theDepartmentisspecificallyconsideredaHealthPlanunderthePrivacyRegulationsoftheHealthInsurancePortabilityandAccountabilityActof1996(HIPAA).Assuch,theDepartmentisaCoveredEntitythatmustadheretotheHIPAAPrivacyRegulationsaspromulgatedbytheU.S.DepartmentofHealthandHumanServices.

AspartofitsHIPAAcomplianceefforts,theDepartmenthasenactedseveralpoliciesandproceduresdetailingtherightsofHealthFirstColoradomembers,theDepartment'spermittedusesanddisclosuresofmemberprotectedhealthinformationandtheDepartment'sadministrativedutiesunderHIPAA.
