Ala. R. Expedited Civ. Action E
Experts
Under the Expedited Scheduling and Discovery Order (Form 1), the plaintiff shall
provide information on experts pursuant to Rule 26, Ala. R. Civ. P., at least 60 days before
the conclusion of discovery. The defendant shall provide Rule 26 expert information at
least 30 days before the conclusion of discovery.
Expert testimony, including testimony by treating physicians, shall be admissible at
trial through live testimony or deposition, unless another means is agreed upon in writing
by the parties.
History
[Effective 1-1-2017.] Comments Rule 26, Ala. R. Civ. P., information on experts is to be provided by all parties sufficiently in advance of the close of discovery to allow depositions of experts to be taken if necessary and allowed. A major change is that expert testimony may be presented by means other than live testimony or deposition if the parties agree in writing. Note from the reporter of decisions: The order adopting the Alabama Rules for Expedited Civil Actions effective January 1, 2017, including Justice Murdock's and Justice Shaw's special writings dissenting to that order, is published in that volume of Alabama Reporter that contains Alabama cases from 200 So. 3d.
