Introductory Note and Disclaimer
INTRODUCTORY NOTE & DISCLAIMER
These instructions are provided to assist judges trying Alabama state criminal cases.
They are not mandatory but are offered as a guide. The Supreme Court of Alabama has
approved the capital murder instructions for the trial and sentencing aspects of capital
cases pursuant to Sec. 13A-5-56 of the Alabama Criminal Code. The other instructions
have been drafted by the Alabama Criminal Pattern Jury Instructions Committee
appointed by the Supreme Court and are meant to be modified by the trial judge as the
law and facts require. Instructions are added and/or revised periodically as needed. We
encourage judges to make suggestions to improve these instructions by contacting the
Chair of the Alabama Criminal Pattern Jury Instructions Committee, Judge Stephen
