Doxing

The Defendant is charged with Doxing.

A person commits the crime of doxing, if he/she intentionally electronically

publishes, posts, or provides personal identifying information of a law

enforcement officer, firefighter, or public servant, with the intent that others will

use that information to harass, harm, or impede the duties of that law

enforcement officer, firefighter, or public servant, and the law enforcement officer,

firefighter, or public servant is actually harassed, harmed, or impeded from

performing his/her governmental function.

To convict, the State must prove beyond a reasonable doubt each of the

following elements:

(1) The defendant electronically published, posted, or provided personal

identifying information of a law enforcement officer, firefighter, or public

servant, [Insert name];

(2) The defendant did so with the intent that others would use that

information to harass, harm, or impede the duties of that law

enforcement officer, firefighter, or public servant, [Insert name];

(3) The law enforcement officer, firefighter, or public servant, [Insert

name], was actually harassed, harmed, or impeded from performing

his/her governmental function;

(AND)

(4) The defendant intentionally published, posted, or provided the

personal identifying information of that law enforcement officer,

firefighter, or public servant.

Personal identifying information includes, but is not limited to, all of the

following

(a) Home address.

(b) Photographs or information of the victim's children,

including the schools they attend.

(c) Any other information that would enable the victim to be

harassed, threatened, or harmed.

[Read as appropriate]: A Law enforcement officer is an officer employed

by the state, county, or municipality who is certified by the Alabama Police

Officers’ Standards and Training Commission and who has the power of

arrest.

[Read as appropriate]: A Firefighter is any firefighter as certified by the

Alabama Firefighters Personnel Standards and Education Commission. The

term also includes any volunteer firefighter who is a member of a certified

volunteer fire department under Section 9-3-17. [See 9-3-17 for

[Read as appropriate]: A Public servant is any officer or employee of

government, including legislators and judges and any person or agency

participating as an adviser, consultant, or otherwise in performing a

governmental function.

[Read as appropriate]: Government is the state, county, municipality, or

other political subdivision thereof, including public county and city boards of

education, the youth services department district, the Alabama Institute for

Deaf and Blind, and all educational institutions under the auspices of the

State Board of Education.

[Read as appropriate]: Governmental Function is any activity which a

public servant is legally authorized to undertake on behalf of a government or

the fire control activities of a member of a volunteer fire department. [13A-10-

1(3)]

A person acts intentionally with respect to a result or to conduct described

by a statute defining an offense when his/her purpose is to cause that result or to

engage in that conduct. [13A-2-2(1)]

If you find from the evidence that the State has proved beyond a

reasonable doubt each of the above elements of doxing, then you shall find the

defendant guilty of doxing.

If you find that the State has failed to prove any one or more of the

elements of doxing, then you cannot find the defendant guilty of doxing.
