Alaska Criminal Pattern Jury Instruction 28.35.080
Failure to Report
, the defendant in this case, has been charged with the crime of failure to report.
To prove that the defendant committed this crime, the state must prove beyond a reasonable doubt each of the following elements:
(1) the defendant was involved in an accident while driving a vehicle;
(2) the accident resulted in injury to or the death of another person or total property damage to an apparent extent of $2,000 or more;
(3) the defendant knew (his) (her) vehicle was involved in an accident;
(4) the defendant knew or should reasonably have anticipated that the accident resulted in injury to or death of another person or total property damage to an apparent extent of $2,000 or more; and
(5) the defendant failed to give notice to the local police department or the Department of Public Safety by the quickest means of communication.
