Misconduct Involving a Controlled Substance - Third Degree - Possession of Schedule IA/IIA Controlled Substance - School/Youth Center/School Bus
, the defendant in this case, has been charged with the crime of misconduct involving a controlled substance in the third degree.
To prove that the defendant committed this crime, the state must prove beyond a reasonable doubt each of the following elements:
(1) the defendant knowingly possessed any amount of a schedule [IA] [IIA] controlled substance;
(2) the possession was [on or within 500 feet of school grounds] [at or within 500 feet of a recreation or youth center] [on a school bus]; and
(3) the defendant acted with reckless disregard as to the location of the possession.
