Misconduct Involving a Controlled Substance - First Degree - Delivery of a IA, IIA, IIIA Controlled Substance To a Person Under 19
, the defendant in this case, has been charged with the crime of misconduct involving a controlled substance in the first degree.
To prove that the defendant committed this crime, the state must prove beyond a reasonable doubt each of the following elements:
(1) the defendant knowingly delivered any amount of a [schedule IA controlled substance] [schedule IIA controlled substance] [schedule IIIA controlled substance] to another person;
(2) the other person was under 19 years of age at the time of the delivery;
(3) the other person was at least three years younger than the defendant at the time of the delivery; and
(4) the defendant acted recklessly with regard to whether the other person was under 19 years of age and at least three years younger than the defendant.
