Alaska Criminal Pattern Jury Instruction 11.61.195(a)(3)
Misconduct Involving Weapons - Second Degree
, the defendant in this case, has been charged with the crime of misconduct involving weapons in the second degree. To prove that the defendant committed this crime, the state must prove beyond a reasonable doubt that:
(1) the defendant knowingly discharged a firearm and
(2) the defendant discharged the firearm at or in the direction of [a dwelling] [a building] with reckless disregard for a risk of physical injury to a person.
