Recruiting a Gang Member in the Second Degree
, the defendant in this case, has been charged with the crime of recruiting a gang member in the second degree.
To prove that the defendant committed this crime, the state must prove beyond a reasonable doubt each of the following elements:
(1) the defendant was 18 years of age or older;
(2) the defendant encouraged or recruited a person to participate in a criminal street gang; and
(3) the person encouraged or recruited was under 18 years of age and at least three years younger than the defendant.
