Alaska Criminal Pattern Jury Instruction 11.56.815(a)(1)
Tampering with Public Records - First Degree
, the defendant in this case, has been charged with the crime of tampering with public records in the first degree.
To prove that the defendant committed this crime, the state must prove beyond a reasonable doubt each of the following elements:
(1) the defendant certified a public record setting out a claim against a government agency or the property of a government agency;
(2) the defendant recklessly disregarded whether the claim was lawful or that payment of the claim was not authorized in the budget of the government agency; and
(3) the defendant intended to [obtain a benefit for any person] [injure or deprive another person of a benefit].
