Alaska Criminal Pattern Jury Instruction 11.56.755
Unlawful Contact – Second Degree
_______________________________________, the defendant in this case, has been charged with the crime or offense, as applicable, of unlawful contact in the second degree.
To prove that the defendant committed this crime, the state must prove beyond a reasonable doubt each of the following elements:
(1) the defendant was arrested for a [crime against a person under AS 11.41] [crime involving domestic violence];
(2) the defendant knowingly initiated or attempted to initiate communication with the alleged victim of the crime that was the basis for the defendant’s arrest; and
(3) the initiation of or attempt to initiate communication took place before the defendant’s initial appearance before a judge or magistrate or before the dismissal of the charge for which the defendant was arrested, whichever occurred first.
