Obtaining Access Device by Fraud
, the defendant in this case, has been charged with the crime of obtaining an access device or identification document by fraudulent means.
To prove that the defendant committed this crime, the state must prove the following beyond a reasonable doubt:
That the defendant [bought an access device or identification document from a person other than the issuer] [as other than the issuer, sold an access device or identification document] [obtained an access device or identification document with intent to defraud] [made a false statement in an application for an access device or identification document with intent to defraud].
