Indecent Exposure - Second Degree
, the defendant in this case, has been charged with the crime of indecent exposure in the second degree.
To prove that the defendant committed this crime, the state must prove beyond a reasonable doubt each of the following elements:
(1) the defendant knowingly exposed [his][her] genitals in the presence of another person; [and]
(2) the defendant recklessly disregarded the offensive, insulting, or frightening effect the act may have had[; and
(3) the other person was under 16 years of age].
