Indecent Exposure - First Degree
, the defendant in this case, has been charged with the crime of indecent exposure in the first degree.
To prove that the defendant committed this crime, the state must prove beyond a reasonable doubt each of the following elements:
(1) the defendant knowingly exposed the defendant’s genitals in the presence of another person;
(2) the defendant recklessly disregarded the offensive, insulting, or frightening effect the act may have had;
(3) the defendant knowingly masturbated while exposing the defendant’s genitals;
(4) the offense occurred within the observation of a person under 16 years of age; and
(5) the defendant was previously convicted of indecent exposure in the first or second degree, or a law or ordinance of this or another jurisdiction with elements similar to those listed in (1)-(4).
