Alaska Criminal Pattern Jury Instruction 11.41.455(b)
Unlawful Exploitation of Minor - By Parent
, the defendant in this case, has been charged with the crime of unlawful exploitation of a minor.
To prove that the defendant committed this crime, the state must prove beyond a reasonable doubt each of the following elements:
(1) in the state of Alaska the defendant permitted a child under 18 years of age to engage in actual or simulated [sexual penetration] [lewd touching of another person's genitals, anus, or breast] [lewd touching by another person of the child's genitals, anus, or breast] [masturbation] [bestiality] [lewd exhibition of the child's genitals][sexual masochism or sadism];
(2) the defendant was the parent, legal guardian, or person having custody or control of the child; and
(3) the defendant knew that the conduct was intended to be used in producing a live performance, film, audio, video, electronic, or electromagnetic recording, photograph, negative, slide, book, newspaper, magazine, or other material that visually or aurally depicts the conduct.
