Alaska Criminal Pattern Jury Instruction 11.41.440(a)(1)
Sexual Abuse of a Minor - Fourth Degree - Defendant under Sixteen
, the defendant in this case, has been charged with the crime of sexual abuse of a minor in the fourth degree.
To prove that the defendant committed this crime, the state must prove beyond a reasonable doubt each of the following elements:
(1) the defendant knowingly engaged in sexual contact with [initials of child];
(2) the defendant was under 16 years of age at the time of the sexual contact;
(3) [initials of child] was under 13 years of age at the time of the sexual contact; and
(4) [initials of child] was at least three years younger than the defendant at the time of the sexual contact.
