Alaska Criminal Pattern Jury Instruction 11.41.434(a)(1)
Sexual Abuse of a Minor - First Degree - Child under 13
, the defendant in this case, has been charged with the crime of sexual abuse of a minor in the first degree.
To prove that the defendant committed this crime, the state must prove beyond a reasonable doubt each of the following elements:
(1) the defendant knowingly [engaged in sexual penetration with [initials of child]] [aided, induced, caused or encouraged [initials of child] to engage in sexual penetration with another person];
(2) the defendant was 16 years of age or older at the time of the sexual penetration; and
(3) [initials of child] was under 13 years of age at the time of the sexual penetration.
