Alaska Criminal Pattern Jury Instruction 11.41.420(a)(5)
Sexual Assault – Second Degree – Sexual Penetration (occurring on or after 1/1/2023)
, the defendant in this case, has been charged with the crime of sexual assault in the second degree.
To prove that the defendant committed this crime, the state must prove beyond a reasonable doubt each of the following elements:
(1) the defendant knowingly engaged in sexual penetration with another person;
(2) the sexual penetration occurred without the consent of the other person; and
(3) the defendant recklessly disregarded the other person’s lack of consent.
