Alaska Criminal Pattern Jury Instruction 11.41.420(a)(3)
Sexual Assault - Second Degree - Victim Mentally Incapable, Incapacitated, or Unaware
, the defendant in this case, has been charged with the crime of sexual assault in the second degree.
To prove that the defendant committed this crime, the state must prove beyond a reasonable doubt each of the following elements:
(1) the defendant knowingly engaged in sexual penetration with another person;
(2) the other person was [mentally incapable] [incapacitated] [unaware that a sexual act was being committed]; and
(3) the defendant knew the other person was [mentally incapable] [incapacitated] [unaware that a sexual act was being committed].
