Alaska Criminal Pattern Jury Instruction 11.41.220(a)(5) #2
Assault - Third Degree - Prior Convictions
Now you must determine whether the defendant has previous convictions.
To prove that the defendant has previous convictions, the state must prove beyond a reasonable doubt the following elements:
(1) the defendant was convicted on two or more separate occasions of any of the following crimes: [insert name of predicate crime(s), see AS 11.41.220(a)(5)]; and
(2) the date that sentence was imposed for each conviction was within 10 years preceding the date of the current offense.
