Alaska Criminal Pattern Jury Instruction 11.41.140
"Person"
A "person," when referring to the victim of a crime, means a human being who has been born and was alive at the time of the criminal act. A person is "alive" if the person has spontaneous respiratory or cardiac function or, when respiratory and cardiac functions are maintained by artificial means, the person has spontaneous brain function.
