Alaska Criminal Pattern Jury Instruction 11.41.110(a)(6)
Murder - Second Degree
, the defendant in this case, has been charged with the crime of murder in the second degree.
To prove that the defendant committed this crime, the state must prove beyond a reasonable doubt each of the following elements:
(1) the defendant knowingly manufactured or delivered a controlled substance in violation of AS 11.71.010 or AS 11.71.021; and
(2) another person died as a direct result of the ingestion of the controlled substance.
For purposes of this instruction, “ingestion” means voluntarily or involuntarily taking a substance in the body in any manner.
