Aggravating Factors - Felony Against Spouse, Former Spouse, Member of Social Unit 12.55.155(c)(18)(a)
______________________, the defendant in this case, was convicted in Count ___ of the crime(s) of ___________________________. You must now determine if the following aggravating factor is proved beyond a reasonable doubt as to this count:
That the offense was a felony specified in AS 11.41 and was committed against a spouse, a former spouse, or a member of the social unit comprised of those living together in the same dwelling as the defendant.
To prove this aggravating factor, the state must prove beyond a reasonable doubt the following:
(1) That the offense for which the defendant was convicted in the above count was a felony specified in AS 11.41, and
(2) That the offense was committed against a spouse, a former spouse, or a member of the social unit comprised of those living together in the same dwelling as the defendant.
If you find from your consideration of all the evidence that each of these propositions has been proved beyond a reasonable doubt, then you shall find the aggravating factor proved, and mark the findings form YES;
If, on the other hand, you find from your consideration of all the evidence that any of these propositions has not been proved beyond a reasonable doubt, then you shall find the aggravating factor alleged by the state to be not proved, and mark the findings form NO.
