Aggravating Factors - Introductory Instruction
Now that you have found defendant _____________ guilty as to Count _____ (describe conviction particularly such as Robbery 2nd degree)/ or Counts __________(insert count numbers and nature of convictions), you must consider whether [a] special circumstance[s], called [an] aggravating factor[s], apply [applies] to this count [or to Counts ______ and ______].
The defendant is presumed innocent of the alleged aggravating factor[s] as previously set out in Instruction No. ____. The state has the burden of proving this [these] aggravating factor[s]beyond a reasonable doubt as previously set out in Instruction No. ____.
[The proceedings will be similar to trial. The state will have the first opportunity to offer evidence. The defendant may choose to offer evidence but has no burden to do so, given the presumption of innocence.]
