Alaska Criminal Pattern Jury Instruction 1.39

Lesser Included - Not Intended to Relieve of Duty

The availability of alternative verdicts for lesser included offenses is not intended to relieve you of your obligation to reach a verdict based on the law and the evidence. If the evidence warrants a verdict of guilty as to the greater offense, you must return such a verdict without being influenced by your ability to find a lesser verdict. Similarly, if the evidence warrants a verdict of not guilty as to any offense, you must return such a verdict without being influenced by your ability to find a lesser verdict.

Alaska Criminal Pattern Jury Instructions 1.39, dated Revised 1999. Prepared by the Alaska Criminal Pattern Jury Instructions Committee; published by the Alaska Court System. The Alaska Court System states that these instructions "have not been approved or promulgated by any court or the Alaska Bar Association."
